1. Greeting
  • 1.1 Welcome to the website [the ‘Website’] of DRAGON ELECTRONICS LTD [‘DE’, ‘We’, ‘Us’ which terms shall be deemed include the officers, employees and representatives and préposes of DE].

  • 1.2 By accessing the Website or placing an order for any product advertised and sold by DE [a ‘DE Product’] on the Website, you [as a customer of any DE Product, ‘You’, ‘Yours’, ‘Yourself’] agree to be bound by the present terms and conditions [the ‘T&Cs’] and the provisions in the links referred to in such T&Cs [the ‘Links’].

  • 1.3 DE reserves the right to amend and update the T&Cs at any time, without prior notice. If You do not agree to be bound by these T&Cs, You must cease to use or access the Website.

  • 1.4 DE provides You with access to this Website solely to enable You to purchase any DE Product for Your personal use. You may not use the Website for any other commercial purpose. DE reserves the right to refuse any order placed on the Website, and to limit quantities of any DE Product which You may order. You must not use the Website or any DE Product for any illegal, prohibited, unauthorized or improper or inappropriate purpose or in any manner which infringes or fails to comply with any applicable law.

  • 1.5 Should there be any discrepancies between the T&Cs, the Website and the Links, the T&Cs shall prevail.

  • 1.6 You should read these T&Cs carefully before purchasing any DE Product as the T&Cs contain important information about any DE Product, Your order and Your rights as a customer.

  • 1.7 This Website is owned and operated by DRAGON ELECTRONICS LTD a company operating in the Republic of Mauritius [‘Mauritius’] and having its registered office at 3F Dragon House, Pump Road, Roche Bois, Mauritius 11601, bearing company registration number 2650 and business registration number C07002650 at the Registrar of Companies of Mauritius.
2. Confidentiality and Data Protection
  • 2.1 The present confidentiality and privacy policy set out in this section 2 applies to Your use of this Website.

  • 2.2 All the personal data [the ‘Personal Data’] and information You submit to DE for the purpose of registration on the Website, use of the Website and purchases on the Website will be kept confidential and processed by DE in accordance with data protection and other legislation applicable in Mauritius.

  • 2.3 DE will collect information from You, including Your Personal Data, when You will register on the Website or order DE Products or when You provide Us with feedback on DE Products. The information DE will collect from You may be used when You register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication from DE or simply browse on the Website.

  • 2.4 You have the right to access and correct the Personal Data which You have provided to DE. You also have the right to cancel, restrain the processing, oppose for legitimate reasons, withdraw consent, to the use of Your Personal Data and impose conditions which will govern the manner in which Your Personal Data will be used.

  • 2.5 In the case of an individual, You must provide information about Yourself. You must register in Your own name and not in the name of another person. You cannot hold Yourself out to be another person and use that other person’s details. In the case of a corporate entity, the information referred to in section 4.4.2 below, must be provided.

4. Login and Registration
  • 4.1 Prior to making any online purchase, You must register online in order to initiate any order transaction. Please refer to the Registration Policy in section 4.2, below.

  • 4.2 Registration Policy
  • 4.2.1 You are free to browse on the Website, however it is mandatory for You to register on the Website if You make a purchase online or make a wish list or shopping cart on the Website.

  • 4.2.2 You are required to keep Your personal details and information in a safe place and not to share such details and information with anyone.

  • 4.2.3 You are also requested to keep Your credentials accurate and updated. In the event that there is any change with regard to Your credentials, please notify DE immediately.

  • 4.2.4 You will be fully and solely responsible for Your use of the Website and orders placed under Your registered account. You will also be fully and solely responsible for the accuracy and completeness of the information You have provided to DE in proceeding to Your registration [including Your name, address, and contact details] as well as Your selection of any DE Products and the address You have provided to DE for delivery purposes.

  • 4.2.5 By registering with DE, You confirm that:
  • You agree to be bound by all the provisions of the T&Cs, the Website and the Links.
    You wish to receive notifications from DE, including newsletters, announcements [phone calls, SMS & WhatsApp] and adverts with online DE offers during specific period or any time.
  • 4.3 DE shall use all reasonable endeavours to protect Your Personal Data in line with applicable Laws in Mauritius.

  • 4.4 You will need to provide the details set out below, as applicable, to enable DE to process Your application for registration, as set out below.

  • 4.4.3 DE reserves the right to accept or refuse a proposed registration at its sole discretion or to accept a registration under certain conditions without any obligation to provide any justification for any decision.

  • 4.4.4 You may be requested by DE, at DE’s sole discretion, to submit additional information, clarification or confirmation as may be required by DE for the processing of Your application for registration.

  • 4.4.5 Upon the receipt of all information with regard to Your application for registration, DE shall process the application and if the application is successful, as appropriate and subject to DE’s discretion, notify You of Your registration and of Your account details in connection with Your proposed purchases on the Website by latest on the next business day by e-mail.

  • 4.4.6 If You have not logged in to the Website for a period of 12 months, the Website will deregister You automatically.

  • 4.4.7 Should You wish to deregister from the Website, You must send an e-mail to webmail@dragonelectronics.mu. The process of deregistration will be undertaken and completed by latest the next business day and a confirmation e-mail will then be sent to You.

  • 4.4.8 If You suspect any use of and | or access to, Your registered account by an unauthorized person or that a third party has hacked into or otherwise tampered with Your registered account [such an event being referred to as an ‘Unauthorised Use’], You must contact DE immediately on +230 206-1888 and ask for DE’s Online Sale Department or by e-mail in writing webmail@dragonelectronics.mu without any delay in order to notify DE of the Unauthorised Use for DE’s information and action. DE will not be liable or responsible for any loss and prejudice, including direct or indirect loss, damage and | or prejudice suffered by You as a result of such Unauthorized Use.

  • 4.4.9 In the event that there is any loss to DE, its officers and employees arising out of or in connection with any Unauthorized Use and | or Your improper or inappropriate use or Your failure to comply with the provisions and T&Cs and the Website, You will fully indemnify and hold harmless DE, its officers and employees from all losses and expenses resulting from Your non-compliance with these T&Cs.

  • 4.4.10 DE reserves the right to suspend or cancel Your registered account or take such measures as it considers necessary and appropriate any time and without notice if DE suspects that You have misused or will misuse the Website, breached the security measures on the Website or used inappropriate language.
5. Price
  • 5.1 DE Products will be sold at the prices advertised on the Website at the time of Your order and such prices will remain unchanged provided that DE receives Your payment within 48 hours of the time You have placed Your order.

  • 5.2 DE reserves the right to change the prices of DE Products at any time, prior to the confirmation of Your order, without notice.

  • 5.3 All prices for DE Products are listed in Mauritian Rupees and are inclusive of value added tax [‘VAT’] at 15% or such other rate applicable at the time of Your order.
6. Offer and Discount
  • 6.1 You should rely on the product text features and specifications in the Website when You place Your order. Photographs and videos of DE Products on the Website are not contractually binding and are for Your guidance only. We reserve the right to withdraw or vary Our offers and promotions at any time, prior to the confirmation of Your order, without notice.
7. Online Purchase
  • 7.1 You must be a registered customer to be able to make online purchases and payments. Payment for DE Products must be made by You in Mauritian Rupees, net of bank charges.

  • 7.2 You must effect payment of the full price or agreed price of the DE Products to DE on the following bank details:

  • 7.3 You may have the option to finance the purchase of Your DE Product by availing yourself of finance facilities from Rogers Capital Credit Ltd. Such finance facilities will have to be considered and if appropriate, approved by Rogers Capital Credit Ltd. The applicable annual percentage rate [‘APR’] will be the present rate as from 15% or such other applicable rate as at the time of Your Purchase.
8. Home Delivery
  • 8.1 Upon Your request and upon Your full payment for Your DE Product, We will arrange for the delivery, free of charge of Your DE Product at Your residential or other address [‘Home Delivery’]. However, Home Delivery will not apply to the purchase of small DE Products including, without limitation, small domestic appliances and fans [together, ‘Small Domestic Appliances’ or ‘SDA’].

  • 8.2 For SDA, upon Your request, We will arrange for You to collect Your DE Product at any one of Our DE pick-up points in the mainland of Mauritius [the ‘DE Pick Up Point’].

  • 8.3 We will strive to deliver Your DE Product between Monday and Saturday within 2 working days of the receipt of Your payment by DE. This will apply to Home Delivery.

  • 8.4 Collection at DE Pick Up Point
  • 8.4.1 You can collect Your DE Product at any of the 11 DE Shops or Warehouse at applicable opening hours:

  • 8.4.2 We will endeavour to make Your DE Product available for collection within 2 working days from the date DE has received Your payment.

  • 8.4.3 We will notify You, in the manner You have requested, by e-mail, SMS or WhatsApp when Your DE Product is ready to be collected at Your selected DE Pick Up Point.
9. Verification of DE Product on Home Delivery and on Collection at DE Pick Up Point
  • 9.1 Our delivery team will unpack, install, test and conduct a quick demonstration of Your DE Product in Your presence or in the presence of the person appointed by You. You will be required to acknowledge receipt of Your DE Product by signing Our delivery note [the ‘DE Delivery Note’].

  • 9.2 You are required to check the condition and conformity of Your DE Products delivered | collected at the time of delivery | collection, before You sign the DE Delivery Note.

  • 9.3 Once a DE Product has been delivered to You, DE will not be liable for any breakages, non-conformity with Your Order or any issue arising with regard to the DE Product.

  • 9.4 Home Delivery or Collection at Pick Up Point of Your DE Products as well as applicable modalities may be impacted by public health and sanitary measures imposed by relevant authorities in Mauritius or events of force majeure including climatic conditions prevailing in Mauritius.

  • 9.5 Home Delivery and Collection at any DE Pick Up Point will be made when You sign the DE Delivery Note.

  • 9.6 You have to show Your NIC as proof of Your identity and Your Receipt as proof of purchase before delivery or collection can be made. Your National Identity Card will be checked by the DE Delivery Team [team at Warehouse] or our Shop Representative [at shops only] at the chosen Pick Up Point.

  • 9.7 The delivery of Your DE Products will be made to You at the address provided by You.

  • 9.8 However, if You request Us to deliver Your DE Products to a third party or a representative appointed by You [the ‘Representative’], You must make the request in writing and provide Us with a copy of the NIC of the Third Party in advance. Upon the delivery of Your DE Products to the Representative, the Representative will have to show his | her own NIC and receipt as proof of purchase to our DE Delivery Team before delivery can be made.

  • Collection at DE Pick Up Point

  • 9.9 The collection of Your DE Product must be made by You or Your Representative at a DE Collection Point.

  • 9.10 If You wish another person to collect Your DE Product from any DE Pick Up Point, You must make the request in writing and provide Us with a copy of the NIC of that Third Party in advance. Our Shop Representative at the Pick Up Point will check the Third Party’s NIC and Your receipt or Invoice as proof of purchase to match the name.

  • 9.11 In order to protect Your interests, DE will not deliver Your DE Products at Your address or at any DE Pick Up Point to any Third Party if the conditions in this section are not completed to DE’s satisfaction. In this event, DE will not be liable for any loss, damage or prejudice arising out of or in connection with any failure or delay in effecting the delivery.

  • 9.12 We will not be liable for the late or non-delivery of any DE Product or for any loss, damage and | or prejudice suffered as a result of any incorrect delivery or other information You have provided to Us or as a result of or in connection with events beyond DE’s reasonable control.
10. Cancellation of Order Policy – Refund Policy – Exchange Policy
  • 10.1 Once a DE Product is sold, it is not exchangeable and non-refundable unless You have received an incorrect DE Product or a DE Product which has a factory defect.

  • 10.2 Once a service is sold, it is not exchangeable and non-refundable

  • 10.3 If You wish to exchange or return any DE Product and|or service after Your payment, DE will consider your request for exchange or return and if considered fit by DE, accept that the DE Product and|or service be exchanged or returned upon Your payment of an Administrative Fee of Rs495.00 inclusive of VAT and a Transport Fee as per Our current rates [available on demand] if Your DE Product has already been delivered and has to be collected by DE from You or is already in transit for delivery.
11. Storage Fee
  • 11.1 A Storage Fee of Rs295.00 inclusive of VAT per week per item will be payable by You in case You have not taken delivery of Your DE Product as agreed. However this Storage Fee will only be applicable after 30 days as from the date of receipt or invoice.
12. Warranty
  • 12.1 Your DE Product will meet Your needs and to use it for many years, it is strongly recommended that You [a] read the owner's manual for Your DE Product thoroughly before using it and keep such owner’s manual handy for reference at all times and [b] comply strictly with safety instructions, installation guidelines and preventive or routine maintenance, as applicable.

  • 12.2 The terms and conditions which specifically relate to warranties on any DE Product [the ‘DE Warranties’ and each of them, a ‘DE Warranty’] are set out below.

  • 12.3 The services relating to the Warranties shall be rendered during DE Service Centre normal working hours from Monday to Friday 08:00 to 17:00.

  • 12.4 DE warrants Your DE Product against damage, fault or failure due to manufacturing defects [the ‘Defects’] provided that You use Your DE Products for the purpose for which it was purchased [the ‘Stated Purpose’]. If You use Your DE Products for any other purpose than the Stated Purpose, the Warranty of the DE Products will not apply. Specifically, the DE Warranty will not apply if You purchase Your DE Product for a household purpose [domestic | home use] and You use such DE Product for a commercial | industrial purpose. The effective commencement date of the DE Warranty will be the date of purchase or delivery of Your DE Product, whichever is later.

  • 12.5 In case of Defect, DE shall have the option either to repair Your DE Product or to replace any defective functional part[s] in Your DE Product with new functional part[s] under the applicable Warranty and all replaced functional part[s] removed from Your DE Product will become the property of DE.

  • 12.6 Consumables, non-functional parts, accessories and wear and tear items such as air filter, battery, bulb of any type, carbon filter, data cable, HDMI cable, microSD card or any other type of memory cards, microwave oven plate, pick-up lens, power adapter or charger, remote control and water filter for refrigerator, which are included in the original factory packing for the product that fail due to a manufacturing defect will be replaced free of charge if they become defective for a period of 6 months from the date of purchase of Your DE Product or delivery of Your DE Product whichever is later.

  • 12.7 For notebook computers, repairs carried out may involve the reformatting of the hard disk drive, solid state drive and | or memory card and consequently the loss of data stored on these devices. It will be Your responsibility to take all steps and precautions which You deem necessary, including the performance of regular data backup before any repair is carried out and DE disclaims all liabilities for any loss including without limitation, data loss.

  • 12.8 In case service is required for notebook computers, You must bring all Your accessories such as power adapter or charger. DE Warranty does not cover accessories and | or peripherals and | or software purchased | downloaded separately and | or any functional and | or operational problems arising from any network systems and | or service providers.

  • 12.9 The DE Warranty will not apply in the circumstances including the following
    [a] when such guarantee is excluded by the applicable specifications of the DE Products or the Stated Purpose,
    [b] where there are minor imperfections in a DE Product [such as exterior body or casing appearance] that do not materially alter functionality,
    [c] when an event occurs during the installation or set-up of a DE Product and where all functional specifications of such DE Products are met,
    [d] Your DE Product suffers from cosmetic damages such as chemical reaction, corrosion, corrosive surroundings, paint work, rust and tea stains. Products in stainless steel must be cleaned regularly to avoid tea stains,
    [e] damage, fault or failure due to improper installation by a third party,
    [f] where a DE Product [such as an air-conditioner] is used in parameters which are outside or beyond the parameters for which the DE Product was purchased, including parameters outside or beyond the capacity and performance of the DE Product,
    [g] the appearance of dead pixels of less than 7 dots on the screens of any DE Product [including without limitation digital signage, hotel TVs, monitors and TVs] will not constitute a defect on the DE Product and the DE Warranty will not apply, unless specifically stated,
    [h] if the original identification marks of a DE Product, including bar codes set out on the DE Product have been removed or altered,
    [i] to damage, fault or failure due to accidents, breakage such as broken glass, burglary, chemical reaction, commercial or industrial use [unless You purchased a commercial | industrial product], corrosion, corrosive surroundings, excessive dust, excessive heat, fire, flood, foreign matter entering the product, humidity, improper electrical grounding, improper installation, improper maintenance, improper movement of the product, improper plug connection, improper transportation, improper ventilation, inappropriate storage conditions, insects, lightning, low water pressure, mishandling, misuse, negligence, oxidization caused by any form of liquid, power surge including abnormal voltage, software, reptiles, riots, rodents, storm, tampering, unauthorized repair, unusual electrical stress, unusual physical stress, use of non-genuine battery and accessories and virus[es].

  • 12.10 DE’s entire liability shall be limited to warranty repair during the warranty period. DE shall not be liable for any loss or damage including, without limitation, consequential damages or loss of whatsoever nature directly or indirectly arising from Your use of, or inability to use the DE Products, or for personal injury or loss or destruction of other property, loss of time and loss of use. Further, DE’s liability in respect of all claims under the DE Warranty shall not exceed the current product market price.

  • 12.11 The Warranty in this section 12 shall be governed by and subject to the Laws of Mauritius and will not affect Your statutory rights as consumer in any way.
13. Functionality of the Website
  • 13.1 We endeavour to provide You with the best service possible.

  • 13.2 We cannot guarantee that the operation of the Website will be uninterrupted or free from technical problems. We will remedy the technical problem as soon as We reasonably can.

  • 13.3 There may be restricted or no access to the Website during periods of maintenance. An alert message will be displayed informing You about same.

  • 13.4 For internet safety purposes, We would encourage You to install firewalls and antivirus programs on Your computer, laptop or mobile phone. DE will not be responsible or be liable for any loss, damage or prejudice arising out and connected to any failure in the internet or for any external intrusion.
14. Applicable Law and Dispute Resolution
  • 14.1 These T&Cs will be subject to and governed by the Laws of Mauritius.

  • 14.2 The Courts of Mauritius will have exclusive jurisdiction with regard to any matter in connection with and arising out of these T&Cs.

  • 14.3 In the event of any claim or dispute between You and DE, the matter shall, as a first step, be discussed between the Parties with a view to reach an amicable resolution of the dispute, failing which the matter or dispute will be referred to the Courts of Mauritius. For the purposes of discussing the matter, You will send to DE a statement setting out the subject matter of the dispute within 15 days of such subject matter arising.
15. Severability
  • 15.1 If any of the provisions of these T&Cs is found to be unlawful, invalid or unenforceable, it will not affect the remaining provisions of the T&Cs which will continue to be valid and enforceable to the fullest extent permitted by the Laws of Mauritius.
16. Disclaimer and Limitation of Liability
  • 16.1 DE, its directors, officers, employees, interns, related entities, affiliates, agents, contractors, suppliers, service providers or licensors shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort [including negligence], strict liability or otherwise, arising from Your use of the Website or any DE Product purchased using the Website, or for any other claim related in any way to Your use of the Website or any DE Product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Website or any content or DE Product posted, transmitted, or otherwise made available via the Website.

  • 16.2 DE does not make any warranty or representation in respect of the Website, the services provided on the Website and on DE Products unless expressly stated in the Website or in the Warranties.

  • 16.3 DE does not guarantee continued and efficient access to and use of the Website or that the information and results posted or obtained from the use of the Website will be error-free and reliable.

  • 16.4 You agree that all material times and in respect of any matter relating to the Website arising out of Your use of the Website, Your use or access to the Website is at your own risk, without any liability or responsibility whatsoever to DE.
17. Indemnity
  • 17.1 You expressly and unreservedly agree to indemnify, defend and hold harmless DE, its parent companies, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees [the ‘Indemnified Parties’] with regard to any prejudice and damages suffered by the Indemnified Parties and with regard to any claim or demand, including reasonable attorney’s fees and costs in connection with, due to and arising out of Your breach of the terms of the T&Cs and this Website.
